Terms of Service

1. Introduction and Acceptance

Welcome to EasyTantz ("EasyTantz," "we," "our," or "us"). EasyTantz is an online platform that helps members of the Jewish community discover and book service providers for Simchas and other life events. These Terms of Service ("Terms") govern your access to and use of our website, mobile experience, and related services (collectively, the "Platform").

By creating an account, browsing provider profiles, sending a booking request, listing services, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not use the Platform.

2. Eligibility

To use EasyTantz you must:

• Be at least 13 years of age. Users under 18 may browse the Platform and create a general account with the involvement of a parent or legal guardian, but bookings, payments, and Provider listings must be made by, or on behalf of, an adult who has the legal capacity to enter into binding agreements;
• Have (or have a parent or guardian who has) the legal capacity to enter into a binding agreement in your jurisdiction when you book a service, list services as a Provider, or make a payment;
• Provide accurate, current, and complete information during registration and keep that information up to date;
• Not be barred from using the Platform under any applicable law or by a prior termination of your account.

If you use the Platform on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms, and "you" refers to both you individually and that entity.

3. The Role of EasyTantz

EasyTantz is a marketplace and booking tool. We do not provide event, photography, catering, music, or any other real-world services ourselves. All services displayed on the Platform are offered by independent third-party providers ("Providers").

When a customer ("Customer") books a Provider through the Platform, the resulting contract for services is between the Customer and the Provider directly. EasyTantz is not a party to that contract and is not responsible for the performance, quality, legality, safety, or outcome of any service booked through the Platform.

We do not employ Providers, do not control how they operate their businesses, and make no representation that any Provider is qualified, licensed, insured, or suitable for your event. You are responsible for evaluating a Provider before booking.

4. Accounts and Security

You may create an account using email and password or by signing in with a supported third-party identity provider (such as Google). You are responsible for:

• Keeping your login credentials confidential and not sharing them;
• All activity that occurs under your account, whether or not you authorized it;
• Notifying us promptly at contact us if you suspect unauthorized access to your account.

We may suspend, restrict, or terminate your account at any time if we believe you have violated these Terms, posed a risk to the Platform or other users, or engaged in conduct that may expose EasyTantz to legal liability.

5. Terms for Customers

5.1 Booking Requests

When you submit a booking request, you make an offer to book the selected Provider on the dates, event type, and pricing shown. A booking is confirmed only once the Provider (or our automated booking flow, where instant booking is enabled) accepts the request. Until confirmed, the requested dates and pricing are not guaranteed.

5.2 Accurate Information

You agree to provide accurate event details, including dates, location, times, and any special requirements. Providers rely on this information to decide whether to accept bookings and to deliver the service.

5.3 Communication and Conduct

You agree to communicate with Providers respectfully, respond to reasonable requests for information in a timely manner, and not use the Platform to harass, defraud, or mislead any Provider.

6. Terms for Service Providers

6.1 Listing Approval

Any person may register as a Provider, but a Provider profile will not appear publicly on the Platform until EasyTantz has reviewed and approved the profile. We may decline, modify, or remove a listing at our discretion, including because of incomplete information, inappropriate content, suspected misrepresentation, or concerns about safety or compliance.

6.2 Accuracy of Listings

You are solely responsible for the accuracy of your listing, including pricing, service descriptions, availability, service areas, add-ons, and any qualifications or credentials you display. You must update your listing promptly when any material detail changes.

6.3 Honoring Bookings

Once you accept a booking request, you agree to perform the service as described and at the price confirmed. If you need to decline a request, propose alternative dates, or cancel a confirmed booking, you must do so through the tools provided on the Platform and communicate with the Customer in good faith.

6.4 Portfolio and Content

You may upload images, videos, captions, and descriptions ("Provider Content"). You represent and warrant that you own or have all necessary rights to that content, that it does not infringe any third party's rights, and that it complies with Section 10 (Prohibited Conduct).

You grant EasyTantz a worldwide, non-exclusive, royalty-free license to host, cache, display, resize, and distribute Provider Content on the Platform and in materials that promote the Platform (for example, search results, sitemaps, social sharing previews, and marketing featuring the Platform). This license ends when you remove the content, except for cached copies reasonably needed for normal operation and backups.

6.5 Independent Business

You operate as an independent business. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and EasyTantz. You are responsible for your own taxes, licenses, permits, insurance, and compliance with laws that apply to your services.

6.6 Off-Platform Circumvention

If you make initial contact with a Customer through the Platform, you agree not to encourage that Customer to complete the booking, payment, or ongoing relationship off-platform in order to avoid applicable Platform fees. Repeated circumvention may result in removal of your listing.

7. Payments, Fees, and Taxes

Payments processed through the Platform are handled by our payment processor, Stripe, Inc. By making or receiving a payment through the Platform, you also agree to Stripe's applicable terms of service.

• Customers authorize the payment amount shown at checkout, which may include service fees, add-ons, and applicable taxes.
• Providers receive payouts to a Stripe account they control, subject to Stripe's payout schedules and verification requirements.
• EasyTantz may charge Providers a platform fee or transaction fee, which will be disclosed before a transaction is completed. We may change fees prospectively by updating our published pricing and giving reasonable notice.
• You are responsible for any taxes, duties, or government charges that apply to your transactions. Providers are solely responsible for reporting and remitting their own taxes.

8. Cancellations and Refunds

Each Provider may publish a cancellation policy on their profile or in their booking terms. That policy governs cancellations, refunds, deposits, and rescheduling for bookings with that Provider. You should review the Provider's cancellation terms before booking.

If a Customer and a Provider cannot resolve a dispute about a cancellation or refund, either party may contact EasyTantz for mediation assistance. EasyTantz is not obligated to resolve disputes between Customers and Providers and does not guarantee any specific outcome, but we may, in our discretion, facilitate refunds, release or hold funds, or take other reasonable action.

9. Reviews and Ratings

Once the event date of a confirmed booking has passed, Customers may leave a rating and review about the Provider who served them. You agree that any review you submit will:

• Reflect your genuine first-hand experience;
• Be truthful and not contain knowingly false statements;
• Not be written, commissioned, or exchanged in return for compensation, discounts, or other consideration;
• Not contain threats, harassment, hate speech, personal information of others, or content that violates Section 10.

We may remove or edit reviews that violate these Terms. By submitting a review, you grant EasyTantz a perpetual, royalty-free license to display that review on the Platform, including after your account is closed, so that the historical record of Provider performance remains accurate.

10. Prohibited Conduct

You agree that you will not:

• Use the Platform for any unlawful purpose or in violation of any applicable law;
• Post content that is fraudulent, defamatory, obscene, harassing, hateful, discriminatory, or that infringes any third party's intellectual property, privacy, or other rights;
• Misrepresent your identity, qualifications, affiliation, or the services you offer;
• Attempt to access, probe, or test the vulnerability of the Platform, bypass security or access controls, or reverse engineer any part of the Platform;
• Use automated tools (bots, scrapers, crawlers) to access the Platform other than tools used by legitimate search engines in accordance with our robots.txt, or to collect information about other users;
• Upload malware, viruses, or any code that interferes with the normal operation of the Platform;
• Use the Platform to send unsolicited commercial messages ("spam"), chain letters, or pyramid schemes;
• Submit chargebacks or payment disputes that you know are not in good faith;
• Create an account under a false identity, use someone else's account, or create multiple accounts to evade suspensions.

11. Content and Intellectual Property

The Platform itself — including its code, design, branding, logos, trademarks, databases, and aggregated content — is owned by EasyTantz or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers any of those rights to you.

You retain ownership of content you submit (profile information, portfolio media, messages, reviews). You grant EasyTantz the license described in Section 6.4 for Provider Content and in Section 9 for reviews, and a similar license for any other user-generated content necessary to operate the Platform and display the content to its intended audience.

If you believe content on the Platform infringes your intellectual property rights, please contact us with the allegedly infringing URL, a description of your work, and your contact information, and we will investigate in accordance with the Digital Millennium Copyright Act or other applicable law.

12. Third-Party Services

The Platform relies on third-party services, including Supabase (hosting, database, authentication), Stripe (payments), Resend (transactional email), and Google (identity). We are not responsible for the availability, accuracy, or performance of these services. Your use of those services is subject to their own terms of service and privacy policies.

13. Suspension and Termination

You may stop using the Platform at any time and may request deletion of your account through our contact page.

We may suspend or terminate your access, remove content, or close your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful activity, or if we are required to do so by law.

Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

14. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant that: (a) the Platform will meet your requirements; (b) it will be uninterrupted, timely, secure, or error-free; (c) listings, reviews, or other content are accurate or reliable; or (d) any Provider will perform as promised or to your satisfaction. You use the Platform and arrange services through it at your own risk.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYTANTZ AND ITS OPERATORS, OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY SERVICES BOOKED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO EASYTANTZ IN THE TWELVE MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless EasyTantz and its operators, owners, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Platform;
• Your violation of these Terms or any applicable law;
• Your violation of any third-party right, including intellectual property or privacy rights;
• Any content you submit, post, or transmit through the Platform;
• Any dispute between you and another user of the Platform, including any dispute arising from a booking.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Except where prohibited, any dispute arising out of or related to these Terms or the Platform will be resolved exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.

Before filing a formal claim, you agree to contact us to attempt to resolve the dispute informally. We will work in good faith to resolve the issue within thirty (30) days of receiving your notice.

YOU AND EASYTANTZ AGREE THAT ANY CLAIM MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where reasonable, notify users by email or through the Platform. Your continued use of the Platform after the effective date of the updated Terms constitutes acceptance of those changes. If you do not agree, stop using the Platform.

19. Miscellaneous

• Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and EasyTantz regarding the Platform and supersede any prior agreements.
• Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
• No Waiver. Our failure to enforce any right or provision of these Terms does not waive that right or provision.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Notices. We may give notices through the Platform, by email to the address on file, or by posting on our website.
